(WEST FRANKFORT, IL) — The West Frankfort City Council Tuesday night approved an ordinance addressing air pollution and limited burning in the city. The ordinance restricts open burning in the city except for ceremonial fires and bonfires in connection with a religious ceremony, school pep rallies, scouting activities and similar purposes. It also allows personal comfort fires, stoves for heating and fireplaces and allows residents of a single or double family dwelling to burn limbs, twigs and leaves from 8 a.m. to dusk. Burning shall be more than 15 feet from any structure. It also allows the mayor to authorize intentional or controlled burning for fire department training and industrial fire training for the fire department. If someone is found to have violated open burning provisions and they admit to it, they will be served with a notice of violation and have to pay a $100 fine. Also if someone’s violation warrants a more severe penalty, the authorized enforcement person may issue the notice of violation and inform the police chief, who can then submit a written request to the city attorney to file a complaint or ordinance violation and/or seek an injunction. The police chief would then send a notice of the written request to the person subject to the action. If any person is found in violation of the open burning provisions, they’ll be fined an amount not to exceed $2,500 for each violation. Each day in violation shall be considered a separate violation.
