(SALEM, IL) — A 21-year-old Brownstown man has filed an appeal in Marion County Court after an oversight enabled him to plead guilty over the counter to a traffic charge stemming from a fatal crash for which criminal charges had not yet been filed. Ryan Feezel was initially charged in July 2016 with improper lane usage following a traffic crash on U.S. 51 just north of Patoka that claimed the life of 48-year-old Kevin Koenegstein, of Odin. In August Feezel pleaded guilty to that charge. In September Marion County prosecutors became aware that the crash had resulted in a fatality and filed a charge of Class 2 felony aggravated DUI resulting in death against Feezel. According to Marion County State’s Attorney Bill Milner, Illinois State Police did not notify the county the charges involved a fatality and Feezel was able to plead guilty and pay the traffic fine over the counter. Milner says that once he found out about the mix up he brought in a special prosecutor and had the guilty plea undone as the state was unaware the incident involved a fatality. Feezel’s attorney Tuesday filed a motion to appeal the state’s move and had previously filed a motion to dismiss the charge. Milner says he’s confident, however, that the law is on the side of the prosecution as he’s sure his predecessor would have done things differently had he been aware the case involved a fatality.
